PRIVACY STATEMENT
This Privacy Statement applies to the Everyday Safer website. @everydaysafer.wa.gov.au (ES Website).
ABOUT THIS PRIVACY STATEMENT
This Privacy Statement sets out how we collect, use and disclose information collected through the ES Website.
Your consent. By using or accessing the ES Website, you are agreeing that the State of Western Australia acting through the Road Safety Commission may collect, use, hold and disclose your personal information or business information as set out in this Privacy Statement.
If you don't agree to this Privacy Statement, then do not access or use the ES Website.
Who this Privacy Statement applies to. This Privacy Statement applies to:
- you – the individual (or organisation) who uses the ES Website; and
- us - the State of Western Australia acting through the Road Safety Commission.
Changes to this statement. We may update this Privacy Statement from time to time. If we change this statement, we will state this on the ES Website.
If you don't agree with the changes, then do not use ES Website. If you continue to use ES Website, the changed Privacy Statement will apply from the time it was changed. The changed privacy statement will replace any previous Privacy Statement.
Other policies. This Privacy Statement does not apply to external websites that are linked on the ES Website. If you follow a link to another website from everydaysafer.wa.gov.au, we recommend that you read the privacy policy of that other website to understand what it does with your information.
INFORMATION THAT WE COLLECT
Personal information
We may collect personal information (e.g. your name and contact details) that you (or someone you authorise) provide us when you use the ES Website, and information about your use of the ES Website.
Website visit data
When you view pages on the ES Website, some technical information is collected about your visit. For example:
- your server address;
- your top level domain name (e.g. .com, .au, .gov);
- the date and the time of your visit;
- the pages you accessed and documents you downloaded;
- the address of the last website you visited;
- the type of browser and operating system you are using; and
- what devices and operating systems you used to access the ES Website.
Only some of this information may be considered to be personal information.
Other information. The ES Website also collects other information about you, and others you are acting on behalf of, such as information regarding requests you have made for support or enquires you have made to us.
HOW WE COLLECT THIS INFORMATION
Requests to provide information
Generally, you will know if we are collecting your personal information because we will ask you for it. For example, if you submit an online form to book an incursion, contact us or subscribe to receive newsletters, we will ask you to provide your name and contact details.
Providing us with the requested information is voluntary. If you do not choose to provide us with the requested information, we may not be able to respond to you or provide you with the service you are seeking.
Automatic collection through the ES Website – use of cookies.
When you visit the ES Website, some statistical information is collected about how you interact with the ES Website (e.g. when you visited, what you do on the site and whether you complete any transactions on the ES Website). We use 'cookies' to collect this type of information. A cookie is a small block of data that is shared between a web server and your computer's browser.
If you do not want cookies to be placed on your computer, you can disable them using your web browser. If you opt out of using cookies, some of the features on the ES Website may not function fully and your ability to browse, read and download information may be impaired. Automatic collection by third parties
We use online tools to gather information about visitors to the ES Website. We use software provided by third party vendors, including the following:
- Google Analytics – a web analytics service that we use to collect data about how you use our site and services.
We only collect anonymous information. via Google Analytics. No identifiable personal data is collected.

USE AND DISCLOSURE
Personal information
The personal information you provide us through the ES Website will be used for the primary purpose for which it was collected. For example:
- to allow us to respond to your incursion booking or contact request; or
- where you have subscribed you to an email newsletter to enable us to send the newsletter to you.
Use of web analytics data
We use the information collected about how you use the ES Website and how the ES Website performs during your visit for statistical and system administration purposes. We do this to help:
- monitor and understand usage trends to make sure the ES Website is meeting the needs of its users;
- understand and enhance your experience of the ES Website (for example, to improve content or make performance improvements);
- monitor and protect the ES Website from cyber security threats.
We do not use the web analytics data to identify you or match it with any other personal information we collect from you.
Other use and disclosure
We may also use and disclose your personal information:
- to conduct our functions;
- for a purpose related to that for which it was collected if you have consented to that use or disclosure, or if you would reasonably expect that personal information would be used for that related purpose;
- where required or permitted by a law (e.g. under the Freedom of Information Act 1992 (WA)) or by a court or tribunal;
- to comply with directions of government authorities; and
- protecting, investigating and deterring fraudulent, unauthorised or illegal activity.
OTHER USE AND DISCLOSURE AND STORAGE OF YOUR INFORMATION
Information collected using the ES Website may be disclosed to, and used by:
· our service providers for the purpose of assisting us to operate, manage and use the ES Website and to conduct our other functions;
· relevant Ministers for the purpose of administering their portfolios; and
· a House or Committee of the Parliament of the State of Western Australia.
HOW INFORMATION IS STORED
[Amazon Web Services]. Information that the ES Website collects about you is stored using [Amazon Web Services]. [Amazon] is subject to both Australian and overseas laws that may require the disclosure of your information (in limited circumstances) to government authorities here and overseas.
We may continue to keep information (including your personal information). We may keep your information, and information about others that you act for, even after you stop using the ES Website. In some cases, this is required by law (such as State records laws).
YOUR OTHER RIGHTS
Access to your personal information. You have the right to access personal information that is collected about you through you use of the ES Website. To access your personal information, contact info@rsc.wa.gov.au.
Correcting your personal information. If you believe that personal information that is held about you in connection with the ES Website is incorrect, incomplete or out-of-date, then please contact info@rsc.wa.gov.au.
Complaints. If you have any enquiries or complaints regarding this Privacy Statement or the way your personal information or confidential information is handled, please contact info@rsc.wa.gov.au.
INTERPRETATION
In this Privacy Statement:
- us (also called we or our) means the State of Western Australia acting through the Road Safety Commission;
- ES Website means the everydaysafer.wa.gov.au website and all associated software and content associated with, or accessible through, that website;
- you means the individual who is using the ES Website and includes any person on whose behalf you are using the ES Website;
- notifications includes messages, requests, directions, notices, orders, approvals, invoices, receipts and other documents and information;
- person includes organisations;
- organisation includes firms, companies, partnerships, joint ventures, associations and other body corporates, and any of their successors or permitted assigns; and
- including, for example and similar words do not imply any limit.
